Giveaway Official Rules

1. Who runs the giveaways

Giveaways on citypacks.com are run by Citybreaks LLC, doing business as City Packs ("City Packs," "we," "us" or "our"). These rules apply to every giveaway shown on the Events page of citypacks.com (each a "Giveaway"). By entering a Giveaway you agree to these rules, to the City Packs Terms of Service and Privacy Policy, and that our decisions about the Giveaway are final.

2. The Giveaway listing

Each Giveaway has its own listing on the Events page showing the prize (with a photo or scan), the points needed per entry, any limit on entries per person, and the date and time the Giveaway ends. That listing is part of these rules. If the listing and these rules ever disagree, these rules control.

3. Who can enter

To enter or win you must:

• be at least 18 years old;
• be a legal resident of one of the 50 United States or the District of Columbia, excluding New York and Florida;
• have one City Packs account in good standing in your own name, with our Terms of Service accepted; and
• not be barred from taking part by any law that applies to you.

City Packs owners, employees, contractors and agents, and the people who live in their households or are their immediate family (spouse, parents, children, siblings), cannot win. One person, one account: entries from extra or shared accounts are void.

4. How to enter

While a Giveaway is open, an eligible person can enter in either of these ways:

• Free entry. Log in to your City Packs account, open the Events page and tap "Claim free entry" on the Giveaway. You get one free entry per Giveaway. It costs nothing and does not require buying anything.
• Points entries. Spend City Packs points on entries at the cost shown on the listing. Points are earned as described on the site (for example, by opening packs or when a friend you referred opens their first pack). Points have no cash value, can't be bought directly, and aren't returned once spent unless we cancel the Giveaway.

A free entry and a points entry are each one ticket and have exactly the same chance of being drawn. If a listing sets a limit on entries per person, the free entry does not count toward that limit. Entries made with bots, scripts, multiple accounts or any method other than the two above are void, and we may cancel the account and any points it holds.

5. How the winner is picked

When a Giveaway's end time is reached, our system automatically draws one winner at random from all eligible entries received during the Giveaway. Each entry is one ticket. We may also draw at the posted end time by hand. Your odds depend on how many eligible entries are received in total and how many of them are yours. If no eligible entries are received, the Giveaway closes with no winner.

6. Winner notice and claiming the prize

The winner's City Packs username is shown on the Giveaway listing once the draw is done. The winner also sees a notice on the site the next time they visit, and we may contact them by the email or phone number on their account. The prize is placed in the winner's City Packs vault.

To claim it, the winner must request shipping from their vault and give a valid United States shipping address within 30 days of the draw. We may ask the winner to confirm their identity, age and state of residence (for example, with a government-issued photo ID) before we ship. If the winner does not claim the prize in time, can't be verified, or turns out to be ineligible, the prize is forfeited and we may draw an alternate winner from the remaining entries or keep the prize.

7. Prizes and shipping

The prize for each Giveaway is described and pictured on its listing. Any value we show is our good-faith estimate; trading card values change, and the winner is not owed any difference between a shown value and the prize's actual value. One prize is awarded per Giveaway unless the listing says otherwise.

City Packs pays for standard shipping of the prize to the winner anywhere in the United States, so the winner never has to pay to receive a prize. If the winner chooses a faster or upgraded shipping option instead, they pay only the difference shown at checkout. Prizes are not exchangeable for cash, account balance or other items and can't be transferred to another person, unless we decide otherwise or the law requires it. If a prize becomes unavailable, we may substitute a prize of equal or greater value. Prizes are provided as described, without any other warranty.

8. Taxes

The winner is responsible for any taxes on the prize. If a prize is worth $600 or more, we may need the winner to complete an IRS Form W-9 before we ship it, and we may report the prize's value to the IRS on Form 1099. We suggest talking to a tax professional.

9. Fair play and changes

We may disqualify anyone we reasonably believe has broken these rules, used more than one account, tampered with the entry process, or acted unfairly toward other players. If fraud, a technical problem or anything else outside our reasonable control affects a Giveaway, we may pause, change or cancel it. If we cancel a Giveaway, points spent on it are returned. We are not responsible for entries that are lost, delayed or not recorded because of technical problems.

10. Usernames and publicity

By entering, you agree that the winner's City Packs username may be shown on citypacks.com and on our social media. Where the law allows, we may also share the winner's first name, city and state in posts about the Giveaway without paying them. We will ask first before using a winner's photo or video.

11. Your information

We use the information on your account to run the Giveaway, check eligibility, contact the winner and ship the prize, as described in our Privacy Policy.

12. Release and limits on liability

To the extent the law allows, by entering you release Citybreaks LLC (City Packs) and its owners, employees and agents from claims arising from your participation in a Giveaway or from receiving, using or shipping a prize. Nothing in these rules limits any right you have that cannot be limited by law.

13. Disputes

These rules are governed by the laws of the state where Citybreaks LLC is organized, without regard to conflict-of-law rules. Any dispute about a Giveaway will be handled individually, not as part of a class or group action, and in the way described in our Terms of Service.
